Complain to your insurer specifically and in writing: identify the decision or handling challenged, why and the remedy sought. A useful letter separates coverage arguments, damage amount and poor communication. Request acknowledgement and a written response. An insurance lawyer can help with major stakes, serious allegations or deadlines. This guide concerns the internal complaint under Dutch law; reporting to the regulator or Kifid has another purpose and needs separate preparation.

1. Define what the complaint should resolve
Choose a main question: reconsideration of refusal, explanation of a calculation or correction of a communication failure? Separate multiple measures. Requesting payment does not itself address registration or contract termination. Identify each desired change and decision so a focused response is possible. Do not merely say the entire process was wrong; name the step or decision supporting that view and what should have happened instead.
Official explanation: Official explanation.
2. Use the designated internal procedure
Find your contracting party’s complaints process, contact details and file requirements. Use the designated channel and keep what was actually sent. The AFM recommends written complaint and response. A call may clarify but does not always replace an identifiable complaint. Request acknowledgement if missing. With an intermediary or authorised agent, check who made the disputed decision. Correct addressing avoids referral between organisations without substantive ownership.
3. Build the letter around facts and documents
Start with policy and file numbers, challenged decision and request. Add a short timeline and numbered arguments. Cite originals and explain each document’s significance. Avoid lengthy repetition of every call if irrelevant. Describe what you do not yet know and the explanation requested. It need not be a court document, but the reader must follow your conclusion from the facts and identify the part of the insurer’s position challenged.
4. Separate service and entitlement to payment
Inappropriate tone or late response may be a separate complaint but does not automatically establish coverage. Conversely, a correct payment can coexist with poor communication. Keep evidence and remedies separate for each point. For payment, ask about policy basis and calculation; for communication, ask for correction, contact and planning. The Verbond describes self-regulation and disciplinary processes alongside individual dispute resolution. A disciplinary finding is not necessarily the same outcome as deciding your money claim.

5. Monitor replies without confusing deadlines
The AFM mentions eight weeks for a substantive complaint response. Within its framework the Verbond provides information on response periods for simple and complex complaints. Check your insurer’s procedure and keep postponements. These are not general deadlines for paying every claim. Track limitation, Kifid access and procedural deadlines separately. An open internal file does not generally confirm preservation of all rights or unlimited time before court action.
For this follow-up question, read Limitation of insurance claims: protect your entitlement in time.
6. Choose the appropriate next step after the reply
Check whether the reply states a final position and addresses every part. Seek missing explanations, but after refusal have the next deadline assessed immediately. Kifid may be an option subject to conditions; check membership and complaint type. You can also obtain advice on court. An AFM report supports supervision but does not resolve your individual dispute. Expressing dissatisfaction with the reply is not automatically timely referral to the correct next institution.
For this follow-up question, read Kifid complaint against your insurer: file, deadlines and legal help.
7. Fictional example: incomplete calculation and silence
Suppose an insured person receives a lower amount without a breakdown, then no answer. He complains in two parts: explain the calculation and resume communication. He attaches the estimate and earlier requests. The response can be assessed per issue. This fictional example predicts no higher amount. Faster replies do not automatically resolve the damage valuation, and a higher payment does not necessarily answer all service questions.
8. Checklist for a complete complaint
For a large or complex dispute ask beforehand whether a lawyer should review the letter. Agree whether the lawyer only advises or also monitors the next steps. Send sensitive documents only when relevant through a suitably secure route. Keep one final version and attachment list for later use.
- Policy and file numbers, correct recipient.
- Specific decision, complaint points and remedy per part.
- Timeline and numbered relevant evidence.
- Delivery proof, acknowledgement and reply date.
- Separate diary for limitation and further proceedings.
Assessing a complaint: which question must the answer resolve?
Suppose an insurer pays €4,000 while your repair estimate is €7,000. ‘I am missing €3,000’ may concern different issues: uninsured work, different quantities, a lower repair price or an excess. Ask not merely for a higher payment but for a breakdown of each difference and the policy basis used. Your estimate supports the requested price; it does not by itself explain why the insurer must cover an item.
A fictional formulation is: ‘I cannot identify the justification for item X in your decision. My estimate gives amount Y. Please explain whether you dispute cover, quantity or price and which documents support that view. I request reconsideration of this item.’ Insert only facts that fit. Check the reply against each question: an apology for late communication is not a substantive answer to the payment difference. Keep unresolved points for the chosen next step.
Frequently asked questions
Can I complain only by telephone?
A call may help, but written complaint and confirmation create a clear file. Follow the designated process and keep documents.
Does a communication error automatically establish cover?
No. Service and insurance cover are separate. Explain what went wrong and your remedy for each.
Will the AFM resolve my complaint?
It may use reports for supervision but does not decide your individual insurance dispute. Examine the appropriate complaint or court route.
Can I keep corresponding without watching deadlines?
No. An ongoing complaint does not automatically preserve every right. Monitor limitation, Kifid deadlines and procedures separately.
