Cancel with a clear requested end date and obtain written confirmation. First check the conditions and whether replacement cover is needed. Stopping a direct debit is no reliable substitute for cancellation. If the insurer terminated your policy, assess grounds, notice and consequences separately. This guide mainly concerns private non-life insurance under Dutch law. Health, life, income and business products can have different rules; do not copy one product’s deadline automatically.

1. Identify who cancels and why
Your cancellation differs from insurer termination. Note reason, policy and desired date: switching, premium change or dissatisfaction? Insurer termination may cite claims history, premium payment or another allegation. Request full grounds and conditions. Ending the relationship does not automatically resolve an existing claim. List ongoing entitlements separately. Who cancels and why determines the questions to put to a lawyer.
2. Check period and cancellation rights
Read duration, renewal and cancellation clauses. Within the framework discussed, Kifid describes daily cancellation after the first year for private non-life insurance, with one month’s notice, and cancellation with renewal changes. This is not universal for every insurance product. Check your policy type and agreements. Note inception and renewal and ask about a different end date. Have a refusal assessed under the actual rules rather than relying on a slogan that cancellation is always immediate.
3. Assess new cover before the old policy ends
If insurance remains necessary, establish whether and when a new insurer accepts. An application or quotation is not automatically a binding policy. Check insured people, risks, conditions and start date. Matching dates mean little if an essential risk is excluded. Answer questions about earlier termination or claims truthfully. A lawyer can advise on forced termination, but that does not automatically remove the practical need for appropriate cover.
4. Send clear cancellation instructions
Use the designated channel and identify policyholder, number and desired end date. Keep the sent text and receipt. Request actual termination and premium settlement confirmation. With a switching service, verify who does what. Do not assume the new insurer cancels all old products. For packages specify which remain and which stop. This prevents a general instruction being misunderstood or necessary insurance ending unintentionally.
5. Keep payment and cancellation separate
Merely blocking collection can create arrears disputes while the insurer considers the agreement active. First establish end date and amount owed. Request an itemised account for disputed premium or refunds. Keep payments and original cancellation. Retroactive cancellation requires separate support and is not automatically enforceable. If an adviser promised cancellation, bring instructions and confirmation: possible execution error differs from the ongoing policy itself.
6. Assess insurer termination
For unilateral termination ask which power and notice are used. Keep the entire letter and identify claims and new-acceptance consequences. A lawyer can test conditions and statutory boundaries. If fraud or registration is involved, treat those decisions separately. Obtaining another policy does not prove the old termination justified; successfully challenging termination does not automatically erase every registration. Make a focused internal complaint and, where urgent, immediately assess further routes and deadlines.
7. Fictional example: switching without confirmation
Suppose an insured person applies elsewhere and assumes the old policy ends. Months later two premiums are still paid. He collects application, adviser instructions, old conditions and confirmations. These show whether cancellation actually occurred, when and what was promised. This fictional example guarantees no refund of all duplicate premiums. Desired switching, new acceptance and ending the old contract are distinct steps, each requiring evidence.
8. Checklist for cancellation disputes
Seek legal advice for disputed end date, forced termination or significant premiums. Agree whether adviser error or registration is included. Meanwhile ensure necessary cover and existing claim deadlines do not fall unnoticed between parties.
- Policy, duration, renewal and cancellation provision.
- Cancellation, delivery evidence and confirmed end date.
- New application, acceptance and coverage differences.
- Premium account, payments and arrears letters.
- Termination grounds, existing claims and separate registration decisions.
Frequently asked questions
Is stopping direct debit enough?
Not as a general approach. Arrange provable cancellation and date; blocking payment can otherwise create a premium dispute.
Can every policy end on one month’s notice?
No. Check product, period and agreements. Private non-life information is not universal.
Does a new application cancel old insurance?
Not automatically. Check who cancels and keep confirmation alongside new acceptance and start date.
Does the old claim end with the policy?
Assess separately. Cancellation and rights from earlier events differ. Keep claim records and monitor deadlines.
