When a buildings claim is refused, first establish which part of the building, cause and policy condition are disputed. Damage to a home is not automatically insured merely because a buildings policy exists. Ask for a substantiated decision and gather evidence of the original condition. An insurance lawyer can assist with exclusions, technical reports or a large financial disagreement. This guide concerns your own buildings insurance under Dutch law. Claims against a contractor, neighbour or another party are separate legal questions and do not replace assessment of the policy.

1. Identify the insured object and interest

Check the policy schedule, risk address and building description. Ask which components, outbuildings or other items fall within cover. A loose piece of furniture may require a different policy from damage to the building. For an apartment, collective insurance and the role of the owners' association may also matter. Do not automatically assume that every owner independently has the same claim route. Obtain the right policy and determine who must submit the claim. This prevents substantive debate about a contract you cannot rely on in the intended way.

2. Record the event and cause

Describe when the damage became visible and what you know about its origin. Keep discovery and cause separate. A damp patch does not independently show whether there was a single incident or a prolonged process. Gather photographs, notifications and technical findings. Ask exactly what the insurer disputes and which investigation method supports that position. Kifid shows for water damage that cause, maintenance and renovation may engage different conditions. Merely labelling something water damage therefore never answers on its own the coverage question under your specific agreement.

3. Distinguish defect, consequential damage and maintenance

For an exclusion, ask which costs the insurer considers repair of a defect and which concern consequential damage. Kifid distinguished these elements in a specific lock case; the outcome followed from that policy and the circumstances. Do not take this as a general rule that consequential damage is always or never paid. Have the relevant clause read alongside the technical report. The same repair invoice can contain different types of work. Ask for an itemisation so a legal dispute about one element does not automatically encompass the entire bill without separate reasons.

If the building defect actually arose from your contractor’s completed work, also consider the separate repair request against the contractor. Not every rejected buildings claim involves a construction defect.

4. Check special situations and limits

Read provisions on renovation, use, vacancy and special objects where relevant to your situation. Report relevant changes under the applicable arrangements and keep confirmation. Kifid shows for garden damage that cover may differ by object and peril. The absence of one exclusion does not automatically prove that something falls within positive cover. Do not use a product name such as all risks as a substitute for the wording. If an adviser made a specific promise, gather that communication and have their role assessed alongside the insurer's.

5. Substantiate repairs and value

Request an itemised repair estimate and compare it with the insurer's calculation. Which component, quantity and method differ? Also check the valuation basis, excess and limits. A guarantee against underinsurance must be read together with any conditions and caps. Distinguish the extent of loss from the coverage dispute. A counter-assessment may be appropriate for establishing the amount, but not every expert assignment qualifies for the same reimbursement. Have the question and costs defined in advance. Keep necessary repair records without unnecessarily making the condition impossible to investigate.

6. Arrange emergency measures and a legal response

Take safety and mitigation seriously and record necessary measures. Ask which permission or documentation the insurer requires. Mitigation costs, maintenance and final repairs are not automatically treated alike. Respond to each ground of refusal with targeted documents and use a written internal complaint if needed. A lawyer can assess whether consultation, Kifid or a court route is appropriate. Identify urgent housing or repair problems specifically. Needing to repair quickly does not automatically prove cover, but may affect the choice of next step.

7. Fictional example: roof leakage during work

Suppose leakage occurs during work, causing internal damage. The owner has a repair quotation, the insurer refers to a renovation provision and a cause investigation is still missing. The file therefore needs the work schedule, original photographs, the contractor's assignment and the exact policy clause. This fictional example predicts neither refusal nor reimbursement. It shows that the cost of making a home usable again does not alone determine whether the policy pays. A possible error by the contractor must also be investigated as a separate question.

8. Checklist for a buildings insurance dispute lawyer

Ask for the object, cause, exclusion and amount to be defined. Discuss missing technical information and who investigates it. Keep possible third-party liability and the policy claim separate in the assignment and monitor deadlines for both.

  • Policy, building description, conditions and special clauses.
  • Timeline, original photographs and cause reports.
  • Changes, maintenance, renovation assignment and confirmations.
  • Repair estimate, expert calculation and payment overview.
  • Refusal by ground, emergency measures and urgent consequences.

Frequently asked questions

Does buildings insurance cover every kind of damage to my home?

No. The object, cause and conditions determine the entitlement. A buildings policy is not a general maintenance or repair guarantee.

Is consequential damage always insured?

That does not follow automatically. Read the specific policy and distinguish cause, defect and repair work. Circumstances and clause must be assessed together.

Does the policy also pay for damage in my garden?

That may differ by object and event. Check positive cover as well as restrictions, rather than looking only for one exclusion.

Can I pursue a contractor at the same time?

A possible claim against a contractor is a separate legal question. Have the basis, evidence, deadlines and relationship to the insurance claim assessed.
