An occupational disability insurance dispute starts with the precise reason: does the insurer consider your incapacity insufficient, apply an exclusion or allege incorrect application information? These are different questions. Request the decision and supporting reports and discuss consequences with an insurance lawyer. Private AOV insurance is not a UWV benefit; do not simply apply WIA rules. This guide concerns AOV under Dutch law and helps prepare a specialist advice file.

1. Find the decisive policy criterion
Collect the schedule, conditions, occupation description and amendments. Check the definition of incapacity, waiting period and exclusions. A diagnosis alone does not establish what the contract insures. Record which criterion the insurer considers unmet. A dispute about duties you can still perform requires a different file from a dispute about inception. Have your actual policy read; a brochure or colleague’s policy is no reliable substitute.
2. Separate medical examination and occupational assessment
Ask which reports support the decision and each expert’s role. Alongside medical information, describe your actual daily duties before incapacity. Specify time spent, physical or mental demands and changes in practice. Do not draw medical conclusions from isolated report sentences. A lawyer with suitable expertise can identify inadequately investigated questions. Note factual errors, such as a task attributed to you that was never part of your occupation.
3. Keep the application and health declaration
Where withheld health information is alleged, original questions, answers and available information matter. Kifid distinguishes intentional deception from other disclosure breaches; consequences require specific assessment. Keep the full declaration, instructions, confirmations and medical adviser correspondence. Your belief that a complaint was unimportant does not automatically answer what you had to disclose. Do not retrospectively alter old information. In an additional explanation state clearly when you first provide it.
4. Treat exclusions as a separate ground
Sometimes the decision concerns a clause excluding particular conditions; sometimes it concerns what insurance would have been agreed with correct information. Kifid explains that an incorrect answer without intent does not automatically have the same outcome as intentional deception. Have the insurer’s exact basis and supporting reasoning assessed. Include the timing of investigation and decision. An application dispute should not quietly replace discussion of your current functional limitations.
5. Respond specifically and protect medical data
List factual corrections, missing information and questions for each report. Use designated medical or secure channels rather than sending your whole medical history to everyone involved without purpose. Ask who needs what and why. This does not mean you can ignore every information request. Discuss necessary cooperation and a responsible response with your lawyer. Keep versions and receipts to avoid later dispute over which report or correction was received.
For individual AOV claims within the Gedragscode Claimbehandeling 2024, article 7.5 gives a right to renewed investigation, a second opinion, if you challenge the insurer’s position. The insurer must inform you after submission and after determining its position. State that you wish to use this right and identify the question and expertise needed. The insurer must also explain who pays and how any share payable by you is determined. This is not a general guarantee of a free investigation of your own choosing; check the code’s scope and monitor other deadlines separately.
6. Specify the financial urgency
If ongoing benefits stop, record payment dates, fixed obligations and expected consequences. Explain the previous amount, when it stops and any announced repayment demand. These are separate decisions. A lawyer can assess an advance, reassessment or urgent proceedings and missing evidence. Financial hardship does not automatically prove a contractual payment obligation, but helps assess urgency. Also monitor claim deadlines; ongoing medical discussions do not automatically protect every right.
7. Fictional example: a different task description
Suppose a self-employed tradesperson receives a termination decision. The occupational assessment assumes mainly administrative work, while diaries and assignments show substantial practical work. He collects the insured occupation description, assignments before incapacity and an actual breakdown of hours. An adviser can examine whether the correct work was assessed. This fictional example establishes no entitlement to benefits. Medical findings, policy criteria and other conditions remain relevant. It shows why an accurate task description may add more than repeating the same diagnosis.
8. Checklist for an AOV lawyer
Ask whether instructions cover ongoing benefits as well as possible termination, application issues or recovery. Discuss expertise needed, costs and suitable complaint or court route. Check whether Kifid can handle your specific complaint; business status does not automatically give access to every consumer route.

Frequently asked questions
Does a UWV decision automatically entitle me to AOV?
No. Private insurance has its own agreed criteria. Another decision may contain information but does not replace policy assessment.
Is every error in a health declaration intentional?
No. Questions, answers, circumstances and supporting evidence require examination. An error’s consequences are not automatically those of deliberate deception.
Can I request reassessment?
Under the applicable Gedragscode Claimbehandeling 2024, challenging the AOV position gives a right to renewed investigation. Notify the insurer; it must explain who pays and how your possible share is determined. Specify the question and monitor other deadlines.
Must I wait until all income disappears?
No. Have announced termination, recovery or formal deadlines assessed in time. Concrete evidence of urgency helps choose the suitable route.
